2. Description of Service
Access Ally is an automated web accessibility scanning tool that helps identify potential accessibility issues on websites. 3. Important Disclaimers
3.1 Automated Testing Limitations
IMPORTANT: Access Ally provides automated accessibility scanning only. Automated tools can detect approximately 30-40% of accessibility issues. Our scans:
- Do NOT guarantee full WCAG, ADA, Section 508, or any other accessibility compliance
- Do NOT replace comprehensive manual accessibility audits
- Do NOT replace testing with assistive technologies (screen readers, etc.)
- Do NOT replace user testing with people who have disabilities
- May produce false positives or miss certain accessibility issues
3.2 No Legal Compliance Guarantee
Access Ally does NOT provide legal advice and does NOT guarantee compliance with any laws or regulations, including but not limited to the Americans with Disabilities Act (ADA), Section 508 of the Rehabilitation Act, Web Content Accessibility Guidelines (WCAG), European Accessibility Act, or any other accessibility laws or standards.
Passing an Access Ally scan does not mean your website is legally compliant or fully accessible. You are solely responsible for ensuring your website meets all applicable accessibility requirements.
3.3 Manual Audit Requirement
We strongly recommend that all users:
- Conduct comprehensive manual accessibility audits by qualified accessibility professionals
- Test websites with actual assistive technologies (JAWS, NVDA, VoiceOver, etc.)
- Perform user testing with people who have various disabilities
- Consult with accessibility experts and legal counsel for compliance matters
- Implement ongoing accessibility monitoring and remediation processes
4. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACCESS ALLY AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Any accessibility-related lawsuits, claims, or legal actions against you
- Fines, penalties, or settlements related to accessibility non-compliance
- Loss of revenue, profits, or business opportunities
- Reputational damage or loss of customers
- Any damages arising from reliance on our scan results
YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND.
5. User Responsibilities
By using Access Ally, you acknowledge and agree that:
- You are solely responsible for your website's accessibility and legal compliance
- You will not rely solely on automated scans for accessibility compliance
- You will conduct appropriate manual testing and audits
- You will consult with qualified professionals for legal and accessibility advice
- You have the right to scan the websites you submit to our Service
6. Indemnification
You agree to indemnify, defend, and hold harmless Access Ally and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Any accessibility claims or lawsuits related to your websites
- Your reliance on our scan results or AI-generated fix suggestions
7. AI-Generated Content
Our Service may provide AI-generated fix suggestions for accessibility issues. These suggestions:
- Are provided as guidance only and may not be accurate or complete
- Should be reviewed and tested by qualified developers before implementation
- Do not guarantee that implementing them will resolve accessibility issues
- May require modification to work correctly in your specific context
8. Acceptable Use
You agree not to:
- Scan websites you do not own or have authorization to scan
- Use the Service to attack, overload, or harm other websites
- Attempt to circumvent any usage limits or security measures
- Resell or redistribute our Service without authorization
- Use the Service for any illegal purpose
9. Modifications to Service
We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We may also update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the modified Terms.
